Affiliate Terms and Conditions Agreement

You must register all sites that will include the Landscapeyourvisions.com affiliate link.

We will provide you with technical specifications describing how to include the links on your site. We will also provide the graphics needed for your site. You may not represent Landscapeyourvisions.com or use its trademarks, logos or other branding in any manner other than providing approved links.

Subscriptions and Tracking
We will be responsible for tracking sales placed by customers who follow links from your site to Landscapeyourvisions.com. This means we will handle all issues pertaining to the purchases that are a result of a link from your site including all customer service inquiries. We will track all customer sales through persistent cookie technology. Each Landscapeyourvisions.com Affiliate Link is issued a unique identification number that is associated with your site. You are responsible to ensure your site is properly formatted and working.

Payment and Product Commission
An Affiliate site will receive $10.00 for each Landscape Vision software download sold to visitors who come from your site.

Payment Schedule
You will earn payments based on sales generated from your site. Payments will be processed once per calendar month when your sale total reaches $100.00.

Policies and Pricing
We have the right to change our prices or policies at any time. Do not include price information in your link to Landscapeyourvisions.com.

Limited License
You have a nonexclusive, limited, revocable right to use our icon and other like images only for the purpose of identifying your site as an Affiliate and to generate sales. You may not modify any of our images. We reserve all rights for the icon, our trade names and trademarks. We may revoke your license at any time by giving you written notice.

Responsibility for Your Site
You will be solely responsible for the development, operation, contents, and maintenance of your site. We take no responsibility for content or functionality of your site.

Relationship of Parties
Nothing in this Agreement creates a partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties.

Limitation of Liability
We are not liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program.

Disclaimers
We cannot guarantee that our site will be uninterrupted or error-free, and we will not be liable for any consequences arising from any interruptions or errors.

Terms and Conditions
The term of this Agreement will take effect upon our acceptance of your Affiliate application and will end when terminated by either party. Either party may terminate this Agreement at any time, for any reason. We may choose to terminate this Agreement if we determine your site content is inappropriate, you have breached any conditions of this Agreement, or if you are sending "spam" (mass, unsolicited e-mail messages) to customers.

You are only eligible to earn payments on Landscape Vision Software downloads purchased during the term of the Agreement. Payments earned through the date of termination will remain payable only if the subscription is not canceled. We may withhold your final payment for a reasonable time to ensure that the correct amount is paid. Upon one-week's notice, Landscapeyourvisions.com may change, suspend or discontinue any aspect of this Agreement. We also reserve the right to modify any portion of this Agreement.

IF ANY PORTION OF THIS AGREEMENT OR ANY FUTURE MODIFICATIONS TO THIS AGREEMENT ARE UNACCEPTABLE TO THE AFFILIATE, OR CAUSE THE AFFILIATE TO NO LONGER BE IN COMPLIANCE WITH THE AFFILIATE AGREEMENT, THE AFFILIATE OR LANDSCAPEYOURVISIONS.COM MAY CANCEL THE AGREEMENT. AN AFFILIATE'S CONTINUED USE OF THE SERVICE CONSTITUTES A BINDING ACCEPTANCE BY THE AFFILIATE.
